CCOs: Get Ready for AI Regulation Before It Arrives at Your Door

AI adoption across small and mid-sized businesses has accelerated greatly in the past few years. Productivity tools powered by AI are now deeply embedded in customer service, and for good reason: the efficiency gains are real, the tools are accessible, and the business case is straightforward.

What's less straightforward is the compliance picture that's forming around it. As AI becomes a standard part of how businesses operate, regulators at the state, federal, and international level are catching up.

The patchwork of requirements is growing more complex by the quarter. For Chief Compliance Officers, the regulatory environment around AI is no longer theoretical. Laws are already in effect, enforcement actions are being filed, and the scope of what's covered is expanding. The good news is that CCOs who get ahead of it now have far more options than those who wait for a regulatory notice to prompt the conversation.

The Regulatory Landscape Is Already Here

When key elements of the federal AI safety framework were revoked in early 2025, many businesses assumed AI regulation had been deprioritized. What happened instead was the opposite. Into that gap, state governments stepped in, weaving a complex web of state-level AI regulations that result in serious compliance challenges for businesses operating across state borders — which is effectively every business with a website.

According to the National Conference of State Legislatures, in 2025 alone, 38 states adopted or enacted around 100 AI-related measures. What materially is changing in 2026 is enforceability: multiple compliance-grade state laws now have effective dates this year, increasing the need for cross-state governance, inventories, and evidence of control.

Some of the specific laws CCOs need to be aware of include:

  • Colorado SB24-205, which took effect February 1, 2026, and requires any business deploying a high-risk AI system affecting Colorado residents to conduct impact assessments and notify consumers when AI makes a consequential decision.
  • California's CPPA regulation, which requires businesses using automated decision-making technology (ADMT) for significant decisions, including hiring, compensation, financial services, housing, and healthcare, to provide pre-use notices to consumers and offer opt-out rights.
  • Illinois House Bill 3773, which, similarly to California CPPA regulations, now requires notification when AI assists with hiring, performance reviews, promotions, or disciplinary actions.
  • The EU AI Act, which for any business whose AI systems affect EU residents, classifies AI into risk tiers and requires conformity assessments, technical documentation, and human oversight provisions for high-risk systems with full enforcement of high-risk provisions beginning August 2026.
  • Texas TRAIGA, which took effect January 1, 2026, banning certain harmful AI uses and requiring disclosures when healthcare providers and government agencies use AI systems that interact with consumers.

The thread running through all of these is the same: regulators want to know what AI you're using, where it's making decisions, and what oversight you have in place. For CCOs, that's an audit readiness question as much as it is a legal one.

The Industries That Will Feel It First

Not all businesses face equal exposure. The industries where AI intersects most directly with consequential decisions about people are the ones drawing the most regulatory attention first.

Financial services is at the front of the line. AI used for credit decisions, loan underwriting, fraud detection, and customer communications is subject to existing fair lending laws as well as new AI-specific requirements. The SEC's 2026 examination priorities reflect a significant shift, with concerns about cybersecurity and AI displacing cryptocurrency as the dominant risk topic. The FTC has also established new mandatory cybersecurity standards for non-bank financial institutions with AI implications.

Healthcare faces both sector-specific AI requirements and broader state-level obligations. Medical practices must notify patients when AI contributes to scheduling, billing, or treatment recommendations, with healthcare-specific requirements already in effect.

Hiring and HR is another high-exposure area. Any organization using AI to assist with recruiting, screening, performance management, or disciplinary decisions now faces disclosure obligations in several states, with more to follow. For CCOs, this means the tools your HR team adopted for efficiency may now carry compliance obligations that nobody flagged at implementation.

Any business serving EU residents faces the full scope of the EU AI Act regardless of where they're headquartered — a fact that many SMBs with international customers have yet to fully internalize.

What CCOs Should Be Doing Now

The businesses that will navigate AI regulation most confidently are the ones that build governance into how they deploy it.

For CCOs, that means several concrete steps that can be taken now, before a regulatory notice forces the issue:

  • Build an AI inventory. You cannot govern what you can't see. Map every AI tool currently in use across the organization and assess what decisions each one influences. A well-mapped AI compliance posture starts with knowing which tier each tool in your stack falls into, not with assuming you are too small to be affected.
  • Assign a compliance owner for AI. This doesn't require a new hire. A designated person within your compliance or legal team who reviews AI tool additions, tracks regulatory developments, and manages annual audits is sufficient for most SMBs.
  • Implement notice and disclosure frameworks. Several laws already require that employees, customers, and consumers be notified when AI is involved in decisions affecting them. Design disclosure templates that meet the strictest transparency requirements while allowing for state-specific customization.
  • Establish human oversight for high-stakes decisions. For AI used in employment, financial decisions, healthcare, and similar areas, implement procedures for human review, appeals, and correction of errors, and document them.
  • Build a quarterly audit cadence. AI compliance is not a one-time assessment. Vendor terms change, tools get added, and regulatory guidance updates regularly. A quarterly review cycle keeps the organization current without requiring a full compliance overhaul every time something shifts.

Final Thoughts

For CCOs, AI regulation is not a future problem. The laws are already in effect, the enforcement actions are already being filed, and the regulators are already building the audit capabilities to pursue them. The organizations that treat AI governance as a strategic function will be better positioned to demonstrate compliance, avoid penalties, and respond confidently when scrutiny arrives.

A Gartner analysis projected that manual AI compliance processes will expose “75% of regulated organizations to fines exceeding 5% of their global revenue” through 2027. The cost of building that governance now is small relative to a single enforcement action.
